Law Forward filed a class action lawsuit in Dane County Circuit Court against the City of Madison, seeking damages for 193 voters who were denied their fundamental right to vote in the November 2024 election.
The lawsuit, filed on behalf of eight named plaintiffs representing the broader class of Madison voters disenfranchised in November 2024, alleges that city officials failed in their duty to count properly submitted absentee ballots, despite having multiple opportunities to remedy the situation before the final vote counts were certified. This filing follows Law Forward’s notice to the City of Madison in March, a prerequisite for lawsuits against municipalities in Wisconsin.
“Making sure every vote is counted is at the heart of our democracy—these voters deserved better,” said Scott Thompson, Staff Counsel at Law Forward. “In Wisconsin, we value the right to vote, and there will be consequences when that right is denied.”
The lawsuit seeks to certify a class composed of the 193 individuals whose ballots were not counted. It also seeks compensatory and punitive damages.
