Every Vote Should Count and Every Vote Should Be Counted

Through no fault of their own, the right to vote was taken away from 193 Madisonians in the Nov. 5, 2024 election. If you are one of those individuals whose absentee ballot was not counted, you received (or will be receiving) a letter from Law Forward explaining the next steps.

What happened?

According to a letter sent by the City of Madison’s Clerk’s Office to the Wisconsin Elections Commission, 193 uncounted absentee votes were discovered in sealed courier bags after the November 5, 2024, election — while there was still time for the votes to be counted and included in state’s final official totals. But no action was taken, and all 193 voters were deprived of their right to vote.

We intend to prosecute a class-action lawsuit on behalf of these 193 voters who were denied the right to vote in the 2024 presidential election.

Would these votes have affected the outcome of this election?

It does not appear that these ballots would have changed the results of any race or referendum on the ballot. But that is beside the point. The main issue is that each of the 193 voters whose ballots went uncounted had their constitutional right to vote violated.

What has been done so far to move this lawsuit forward?

Law Forward drafted and served “Notices of Claim” on the City of Madison and Dane County. These notices inform those entities that we intend to bring a lawsuit regarding the 193 ballots that were not counted in the November 2024 election.

What will happen next?

Now that the notices have been served, the City of Madison and Dane County have 120 days to consider our claims before we may file a formal lawsuit.

We continue to investigate this ordeal and meet with individuals who were denied the right to vote and who may be interested in helping to lead this effort.
