Priorities USA et al v. WEC et al

This case considers whether absentee-ballot dropboxes are legal, similar to the Teigen matter. Law Forward submitted an amicus brief in Priorities on behalf of the clients we represented in Teigen–Disability Rights Wisconsin, the League of Women Voters of Wisconsin, and Wisconsin Faith Voices for Justice.
Our amicus brief argues that absentee-ballot drop boxes reduce inequalities in Wisconsin’s voting system. They provide safe and effective methods for ballot return, especially for voters with disabilities, voters of color, and rural voters who face additional challenges in accessing polling locations. Additionally, the brief described how a reflexive application of Wisconsin Statute § 6.84 (as in Teigen) jeopardizes the rights of absentee voters by discounting or contravening other statutory and constitutional protections. On behalf of our clients, we urged the Court to reject discriminatory barriers and uphold the right to vote for all eligible citizens.

The Wisconsin Supreme Court issued an opinion which authorizes absentee-ballot droboxes in municipalities across for Wisconsin ahead of the 2024 primary and general election.

Preserving the constitutional freedom to vote is central to Law Forward’s mission, and we are proud to represent organizations dedicated to advocating for accessible voting, particularly for vulnerable populations. Ensuring this certainty before the upcoming elections is critical so that our nearly 2,000 clerks, who are members of our communities and dedicated public servants, can administer voting in a consistent and uniform manner.
