On May 14, 2024 we, along with Common Cause Wisconsin, Wisconsin Faith Voices for Justice, Leaders Igniting Transformation, the Wisconsin Democracy Campaign, the ACLU of Wisconsin, Fair Elections Center, All Voting is Local and the Wisconsin Fair Maps Coalition submitted a public comment to Attorney General Josh Kaul regarding Dane County’s request for clarification of the recently passed constitutional amendment. The amendment raises critical legal questions of statewide importance that could affect election officials, voters, and advocacy organizations across Wisconsin.

Our fundamental right to vote is guaranteed by the Wisconsin Constitution and the amendment must align with democratic principles and the preservation of this right. Any interpretation of the amendment should support the free, safe, and secure execution of elections rather than impose barriers to voting.

Wisconsin law already comprehensively governs election administration and warns against any unduly expansive reading of the amendment that could hinder the effective administration of elections. 

We urge Attorney General Kaul to issue guidance that maintains the openness and integrity of Wisconsin’s elections and protects the rights of all voters.

In addition to addressing election administration, the letter highlights the interconnected rights to organize,
speak, assemble, and petition the government. It advocates for these foundational rights to remain unaffected by the amendment, supporting the ongoing work of various groups in facilitating voter participation.
